Aliens Enemies Act does not require "warring government per say either. People want to limit the scope of AEA even as it includes incursions and invasions. Trump dropped EOs that specify those conditions with Venezuela exist - especially government assistance.
In the case of TdA, that would be an act of war from Venezuela and acts of treason by Biden and Boasberg. Trump should take military action against Venezuela, and direct AG Bondi to charge Biden and Boasberg with Treason. What we do about China is cut-off all trade and commerce. That would be a difficult but necessary action to take with China.

I see your point and Root's. But the Senate hasn't done made that vote since 1942.
